What the FMCSA Clearinghouse actually requires

A straightforward look at query obligations, violation reporting, and what employers and TPAs are responsible for.

What Is the FMCSA Clearinghouse:

The FMCSA Drug and Alcohol Clearinghouse records drug and alcohol program violations for CDL and CLP drivers covered by 49 CFR Part 382. It helps employers check whether a driver is prohibited from safety-sensitive work. Its requirements are specific to FMCSA-covered operations, not every DOT testing program.

Employer & TPA Obligations:

  • Full pre-employment queries for covered drivers, with the driver’s specific electronic consent in the Clearinghouse
  • Queries at least annually for covered current drivers; limited queries require consent obtained outside the Clearinghouse
  • Timely reporting of the violations and return-to-duty information assigned to employers; MROs and SAPs have separate reporting duties
  • Required follow-up on query results and confirmation that a driver may perform safety-sensitive work before returning to those duties

Why This Trips Programs Up:

Clearinghouse compliance is deadline-driven and detail-sensitive: a missed annual query or a delayed violation report can create exposure even when the underlying program is otherwise well run.

How Unity Manages This For You:

Unity can act as your designated C/TPA for authorized Clearinghouse queries and employer reporting tasks. We agree on the work, confirm the required designation and access, and coordinate records and follow-up with your team. Your organization remains responsible for compliance, driver consents, and employer decisions, including removal from safety-sensitive duties when required.

How Clearinghouse support gets started

  1. Confirm the covered drivers and the query or reporting tasks Unity will support.
  2. Designate Unity as your C/TPA in the Clearinghouse and arrange the required driver consents and employer query plan.
  3. Coordinate queries, records, and follow-up. Your employer team reviews results and takes required employment and safety-sensitive-duty actions.

A limited query that finds a record must be followed by a full query within 24 hours. If that full query is not completed in time, the driver must be removed from safety-sensitive functions until it is completed and the result permits those duties.
