START WITH YOUR COVERAGE
Which agency’s requirements apply?
Your industry, covered functions, and employees’ duties help determine which rules apply. Start with the applicable agency requirements, then define how your organization will put them into practice. Employers with more than one regulated operation may need to address more than one agency.
FMCSA
Motor carrier programs for covered commercial drivers. 49 CFR Part 382.
FAA
Aviation programs for covered safety-sensitive functions. 14 CFR Part 120.
FRA
Railroad programs for covered and regulated service. 49 CFR Part 219.
FTA
Public transportation programs for covered safety-sensitive functions. 49 CFR Part 655.
PHMSA
Pipeline programs for covered operations, maintenance, and emergency-response functions. 49 CFR Part 199.
USCG
Maritime chemical testing requirements. 46 CFR Parts 4 and 16. USCG follows Part 40 for drug testing.
Coverage depends on the applicable rules and the work performed, not simply an employee’s job title.
FROM DOCUMENT TO DAILY PRACTICE
The questions a useful policy should answer
1. Who does the policy cover?
Identify covered employees, work locations, and safety-sensitive duties. If you also test non-DOT employees, clearly distinguish that program from regulated testing. DOT and non-DOT tests must be kept separate.
2. What other laws need review?
Consider the states and localities where employees work, along with applicable employment laws, statutes, privacy obligations, collective bargaining agreements, and cannabis-related rules. These questions deserve workplace-specific review, particularly for non-DOT testing and employment decisions.
3. How will people follow it?
Define testing events, employee instructions, supervisor responsibilities, reporting contacts, and the steps for responding to results or refusals. Make sure the written policy matches your actual workflow and that employees receive the required information.
4. How will it stay current?
Assign responsibility for maintaining the policy, recording acknowledgments, and reviewing changes in your workforce, operations, or applicable requirements. Plan for communicating revisions and keeping the current version accessible.
